Under the UAE labour law, a probation period can last up to six months and cannot be extended. During probation, an employer can end the contract with 14 days’ written notice. An employee who wants to move to another UAE employer must give one month’s written notice, and an employee who is leaving the UAE must give 14 days’ written notice. Once probation ends and you stay on, the probation months count as part of your service.

Those are the headline rules for the private sector, set by Federal Decree-Law No. 33 of 2021, which took effect on 2 February 2022. The details below cover what they mean in practice.

How long can probation last?

Up to six months. The law does not allow it to be extended beyond that, and it applies only once in each employment.

If you complete probation and continue working, the probation period is counted as part of your total service — it is not “lost” time when your end-of-service entitlements are worked out.

Notice periods during probation

Situation Notice required
Employer ends the contract during probation 14 days’ written notice
Employee resigns to join another employer in the UAE At least one month’s written notice
Employee resigns to leave the UAE 14 days’ written notice

Notice should always be given in writing. A verbal resignation or a verbal dismissal leaves both sides without a record if there is a dispute later.

Changing jobs during probation

You can move to a new employer in the UAE while on probation, but two things apply.

You give at least one month’s notice. That is longer than the 14 days required if you are leaving the country.

Your new employer compensates your current employer for your recruitment costs, unless you and your current employer have agreed otherwise. This is between the two employers — it is not deducted from you — but it is worth raising with your new employer early, because it is a cost they will factor in.

Leaving the UAE during probation — and coming back

If you resign during probation to leave the UAE, you give 14 days’ written notice.

If you then return to the UAE within three months on a new work permit, your new employer becomes liable to compensate your previous employer for your recruitment costs, unless otherwise agreed. Plan any return with that in mind, and tell your new employer.

What probation means for your visa

Your residence visa is tied to your employment. If your contract ends during probation, your employer cancels the work permit and visa, and you move into the grace period that applies after cancellation. Use that time either to leave or to secure a new employer’s visa — overstaying after the grace period leads to daily fines.

This is also the stage where document problems appear. A new employer’s visa application often needs your degree attested, and for some roles your qualification recognised by the Ministry of Higher Education. If you are switching jobs, check what the new employer needs before your current visa is cancelled — attestation for documents from abroad takes weeks, not days.

Your rights during probation

Probation does not remove your basic rights under the labour law. You are entitled to your agreed salary, paid on time through the Wage Protection System where it applies, and to the working-hours and rest-day protections that apply to every private-sector employee.

If you have a dispute with your employer — over unpaid salary, notice or termination — you can file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE) through its app, website or call centre on 600590000.

Common mistakes

  • Resigning without written notice. Always put it in writing and keep a copy.
  • Giving 14 days when moving to a new UAE employer. The requirement is at least one month.
  • Assuming probation can be extended. Six months is the ceiling.
  • Letting the visa lapse before the new job’s documents are ready. Get attestation under way early.
